LOCAL AUTHORITY SEARCH
Every property transaction in England and Wales involves conveyancing searches, the most common of which is the "Local Authority Search".

Local Authority Search is more correctly termed a search of the Local Land Charges Register (maintained by the local authority) plus Additional Enquiries of the local authority. It is usually submitted in two parts; form LLC1 and form CON29. Form LLC1 is an Official request, submitted in duplicate by a Legal Practitioner or a member of the public to the appropriate Local Authority asking for a search of the Local Land Charges Register to be conducted. The Local Authority is under a statutory duty to comply with that request. The CON29 form contains a set of standard questions plus a series of additional questions that may be asked if they are considered to be relevant to a transaction. It's a contractual document, by accepting the fee the Local Authority agrees to answer some or all of the questions contained on the form. The results from the search consist of relevant information on legal and financial restrictions, notices and charges against the property held by the local authority. It consists of legal, financial, planning, drainage, building control and environmental health information relevant to a property.

The Local Authority Search is normally held by conveyancers acting on behalf of a client purchasing or selling property. The information is obtained by the local authority within which the property is situated. The distribution method of submitting and response of the search is by post with a provision for personal attendance, mostly used by agents. An automated distribution method is to be introduced by the National Land Information Service /NLIS/. The search could be carried out personally as well, contacting the appropriate local authority.
